Gdyby wyjaśnienie w powyższym czasie okoliczności potrzebnych do ustalenia odpowiedzialności ubezpieczyciela lub wielkości świadczenia okazało się niemożliwe, świadczenie powinno być spełnione w ciągu 14 dni od dnia, w którym przy prowadzeniu stosownej staranności wyjaśnienie tych okoliczności było możliwe. Jednakże bezsporną część świadczenia ubezpieczyciel powinien spełnić w czasie 30 dni od dnia zgłoszenia szkody. Zgodnie z § 3   powołanego artykułu, umowa ubezpieczenia (np. negocjowana indywidualnie)  lub ogólne warunki ubezpieczenia mogą przewidywać inne terminy, lecz tylko takie, jakie są  korzystniejsze dla uprawnionego do świadczenia, niż terminy określone w przepisach kodeksu cywilnego. Także w przypadku ubezpieczeń dobrowolnych -   zgodnie z art 16 ustęp 2 ust. z dnia 22 maja 2003 r. o działalności ubezpieczeniowej (Dziennik ustaw Numer 124, poz. 1151 ze zm) - jeżeli  towarzystwo ubezpieczeń  nie zachowa  terminu wypłaty świadczenia zaplanowanego w umowie, lub też w kodeksie cywilnym, jest zobowiązany do pisemnego obwieszczenia osoby zgłaszającej roszczenie o odszkodowanie o przyczynach niemożności spełnienia zgłaszanych roszczeń. W przypadku zajścia nieuzasadnionej zwłoki  w postępowaniu likwidacyjnym uprawnionemu do świadczenia przysługują odsetki ustawowe, o ile zawarta umowa ubezpieczenia nie prognozuje innej wysokości odsetek. Jak widać, istnieją pewne różnice pomiędzy terminem likwidacji szkody w ubezpieczeniu obowiązkowym a terminem w ubezpieczeniu dobrowolnym.  W wypadku ubezpieczenia obowiązkowego przepisy ustaw. o ubezpieczeniach obowiązkowych regulujące kwestię czasu trwania postępowania likwidacyjnego są przepisami bezwzględnie obowiązującymi, a więc nie jest możliwe stosowanie innych terminów - oczywiście termin 30 dni jest terminem granicznym, nie oznacza to, że towarzystwo ubezpieczeń nie może wypłacić odszkodowania przed upływem tego terminu. W przypadku zaś ubezpieczeń dobrowolnych,  przepisy kodeksu cywilnego, wskazując 30 dniowy termin likwidacji szkody dopuszczają  przyjęcie w umowie innego terminu, pod warunkiem jednak, iż będzie to termin korzystniejszy dla poszkodowanego. Kolejną różnicą pomiędzy regulacjami określającymi terminy likwidacji szkody w ubezpieczeniach obowiązkowych i dobrowolnych jest  wprowadzenie w ubezpieczeniach obowiązkowych górnej granicy czasu likwidacji szkody w wielkości 90 dni od dnia złożenia zawiadomienia o zdarzeniu, przy czym  przekroczenie tego terminu  jest możliwe - jak było już mówione wcześniej - jedynie w wypadku, gdy stwierdzenie odpowiedzialności towarzystwu ubezpieczeń lub też zdefiniowanie wysokości świadczenia uzależnione jest od toczącego się postępowania karnego lub cywilnego. Przepisy regulujące kwestię terminu likwidacji szkody zawierają także różnice dotyczące możliwości nakładania przez Knf na towarzystwa ubezpieczeń sankcji z tytułu bezpodstawnej zwłoki w wypłacie zadośćuczynienia, jak również niespełnienia obowiązku obwieszczenia poszkodowanego o przyczynach zwłoki w wypłacie odszkodowania i prawdopodobnym terminie jego zapłaty - o ile w ubezpieczeniach obowiązkowych Komisja Nadzoru Finansowego ma obowiązek nałożenia sankcji, o tyle w przypadku ubezpieczeń dobrowolnych decyzję o nałożeniu sankcji podejmuje sama Komisja. Zdarza się także, iż towarzystwa ubezpieczeń, na podstawie stworzonych przez siebie procedur, ustalają termin np. 30 dniowy odpowiedzi na pismo złożone przez skarżącego. Procedury te jednak nie wiążą osoby  składającej to pismo, gdyż jedynymi wiążącymi terminami są terminy zawarte w powyżej omówionych przepisach regulujących kwestię terminu likwidacji szkody. Nie istnieją bowiem przepisy szczególne, które wprowadzałyby odrębny termin odpowiedzi na pismo odwoławcze od stanowiska zakładu ubezpieczeń. Nadto, zauważyć należy, że zakwestionowanie stanowiska zakładu ubezpieczeń przez osobę składającą odwołanie jest najczęściej jedynie żądaniem dokonania weryfikacji i korekty poczynionych przez  ten zakład ustaleń, a nie zgłoszeniem okoliczności wymagających wyjaśnienia. Dlatego też, w związku  z faktem, iż składane odwołania  mają  najczęściej  ścisły związek  z  przyjęciem przez zakład ubezpieczeń   błędnych   danych,  sprawdzenie tych danych winno odbyć się w ramach wyznaczonego przepisami terminu likwidacji szkody i skutkować ewentualnym naliczeniem odsetek za zwłokę w likwidacji szkody. Zdarzają się również przypadki, gdy osoba uprawniona do świadczenia przekazuje zakładowi ubezpieczeń dodatkowe informacje mające wpływ na proces likwidacji szkody, bądź kwestionuje rozwiązania przyjęte przez towarzystwo ubezpieczeń np. na podstawie błędnych bądź niepełnych informacji przekazanych przez samego uprawnionego do zadośćuczynienia - wówczas  odwołanie takie  w pewnych sytuacjach  może  być zakwalifikowane jako okoliczność do uzasadnienia, jednak winna być ona wyjaśniona  w możliwie najkrótszym terminie tj. przy prowadzeniu należytej staranności.
